Terms of Service
Effective: 4 October 2026 · Version 2026-10-04
These terms are an agreement between you and Thamanisha ("Thamanisha", "we") and govern your use of the Thamanisha website, web application, mobile application and public API (together, the "Service"). The registered legal entity that operates Thamanisha will be named here once incorporated. By creating an account or using the Service you agree to these terms and to the Privacy Policy. If you do not agree, do not use the Service.
1. What Thamanisha is — and is not
Thamanisha provides impersonal, published, educational analysis of Kenyan money decisions: government securities, collective investment schemes, registers and personal-finance frameworks, in English and Kiswahili.
- The Service is not investment advice. Nothing in it is a recommendation, personalised to you, to buy, sell or hold any security or product, and no returns are promised or implied. Advising on securities for remuneration requires an investment adviser licence from the Capital Markets Authority under the Capital Markets Act (Cap. 485A).
- Thamanisha does not currently hold a CMA licence. Until it does, features that would require one — including any analysis based on your own finances, placing orders and moving money — are switched off and labelled as such. We will tell you in the product if that changes.
- We never hold, move or custody your money. Account connections, where offered, are read-only. Any investment you make, you make yourself, directly with the relevant provider (for example DhowCSD).
- Calculators and figures are illustrations based on the inputs you choose and on cited public sources, with the publisher's date shown. They are not forecasts.
- Before acting on anything you learn here, consider getting advice from a CMA-licensed investment adviser.
2. AI-generated content
- The Financial Coach (on the web, WhatsApp and USSD) and document analysis produce text generated by AI models from third-party providers, described in the Privacy Policy.
- AI output can be incomplete, out of date or simply wrong, including figures read from your documents. Check anything that matters against the cited source or the original document.
- The coach is instructed to give general education only and does not receive your account data. Its answers are not advice, are not reviewed by a person before you see them, and do not create any adviser–client relationship.
- You must not use the coach to generate content that breaks the law or these terms.
3. Eligibility and your account
- You must be at least 18 years old to use the Service.
- You are responsible for the accuracy of the information you provide and for keeping your sign-in secure.
- Tell us promptly at legal@thamanisha.com if you believe someone else has used your account.
4. Plans, billing, cancellation and refunds
- The free tier stays free. Paid plans (such as Core and Plus) and paid programmes are charged at the price shown at checkout; the currency and amount are stated before you pay. There are no hidden fees.
- Card subscriptions (processed by Stripe, or Whop where offered) renew automatically each month or year until you cancel. Cancel any time in Billing — "Cancel subscription", or "Manage billing" to use Stripe's billing portal. Cancellation stops future charges; your plan stays active until the end of the period already paid for, then moves to Free.
- M-Pesa and bank-transfer payments (processed by Paystack) are one-off payments for the period or item shown. They do not renew automatically, so there is nothing to cancel; the plan simply ends when the paid period does.
- Refunds. If you were charged in error, charged after cancelling, or charged twice, email legal@thamanisha.com with the payment reference from your receipt. Approved refunds go back to the original payment method through the same provider (card via Stripe; M-Pesa via Paystack). Your rights under the Consumer Protection Act, 2012 are not affected.
- We email a receipt for each payment. A receipt is not a tax invoice unless it shows a KRA eTIMS invoice number.
- Deleting your account does not cancel a card subscription held by the payment provider — cancel it in Billing first.
5. Acceptable use
- Do not use the Service to break the law, infringe others' rights, or attempt to gain unauthorised access to our systems or data.
- Do not scrape, resell or republish the Service's content or data at scale without our written permission. API usage is governed by the published API terms and rate limits.
- Do not present Thamanisha's educational or AI-generated output to others as personalised financial advice.
6. Connected accounts
If you connect financial or accounting accounts, you grant us read-only access via tokenised, scoped consents. We never receive your bank, M-Pesa or brokerage passwords. You can revoke each connection at any time; what happens to its data afterwards is set out in the Privacy Policy.
7. Intellectual property
The Service, its content, design and software are owned by Thamanisha or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the Service. Your own data remains yours.
8. Disclaimers
The Service is provided "as is" and "as available". We cite sources and work to keep information accurate and current, but markets change and errors are possible — we do not warrant that any information is complete, accurate or up to date. Investment decisions carry risk, including loss of capital, and are yours alone.
9. Limitation of liability
To the maximum extent permitted by Kenyan law, we are not liable for indirect or consequential loss, or for investment losses arising from decisions you make. Nothing in these terms excludes liability that cannot be excluded by law, including liability for fraud or under the Consumer Protection Act, 2012.
10. Suspension and termination
You may delete your account at any time from Settings. We may suspend or terminate accounts that materially breach these terms, with notice where practicable.
11. Changes to these terms
This is version 2026-10-04. When we make a material change we publish a new version and the app asks you to review and accept it before you continue using the Service. If you do not accept, you can delete your account.
12. Governing law and disputes
These terms are governed by the laws of the Republic of Kenya. If a dispute arises, contact us first and we will try in good faith to resolve it within 30 days. Failing that, the courts of Kenya have exclusive jurisdiction, without affecting your right to complain to a regulator such as the Data Protection Commissioner or the Competition Authority of Kenya.
