Terms of Service

These terms govern your use of Thamanisha — the website, web application, mobile application and public API (together, the "Service"). By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.
1. What Thamanisha is — and is not
Thamanisha provides impersonal, published, educational analysis of Kenyan money decisions: government securities, collective investment schemes, registers and personal-finance frameworks, in English and Kiswahili.
- The Service is not investment advice. Nothing in it is a personalised recommendation to buy, sell or hold any security or product, and no returns are promised or implied. (Capital Markets Act, Cap. 485A.)
- Thamanisha is not currently licensed by the Capital Markets Authority as an investment adviser. Features that require a licence are visibly switched off until such a licence is obtained.
- We never hold, move or custody your money. Account connections, where offered, are read-only. Any investment you make, you make yourself, directly with the relevant provider (for example DhowCSD).
- Figures shown in the Service are illustrations based on cited public sources — they are labelled as illustrations and are not forecasts.
2. Eligibility and your account
- You must be at least 18 years old to use the Service.
- You are responsible for the accuracy of the information you provide and for keeping your sign-in credentials secure.
- You must notify us promptly of any unauthorised use of your account.
3. Plans, billing and cancellation
- The free tier stays free. Paid plans (such as Core and Plus) and paid programmes (such as cohorts) are billed at the prices shown at checkout, monthly or annually.
- Prices are shown USD-first with KES equivalents; the charged currency and amount are stated before you pay. There are no per-action charges and no hidden fees.
- You can cancel a subscription at any time from Billing; access continues to the end of the paid period. Statutory refund rights are unaffected.
4. Acceptable use
- Do not use the Service to break the law, infringe others' rights, or attempt to gain unauthorised access to our systems or data.
- Do not scrape, resell or republish the Service's content or data at scale without our written permission. API usage is governed by the published API terms and rate limits.
- Do not present Thamanisha's educational output as personalised financial advice to third parties.
5. Connected accounts
If you connect financial accounts, you grant us read-only access via tokenised, scoped consents. We never store your bank or brokerage credentials. You can revoke each connection at any time from your dashboard, and every connection is listed in your consent ledger. Our handling of that data is described in the Privacy Policy.
6. Intellectual property
The Service, its content, design and software are owned by Thamanisha or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the Service. Your own data remains yours.
7. Disclaimers
The Service is provided "as is" and "as available". While we cite sources and work to keep information accurate and current, markets change and errors are possible — we do not warrant that any information is complete, accurate or up to date. Investment decisions carry risk, including loss of capital, and are yours alone.
8. Limitation of liability
To the maximum extent permitted by Kenyan law, Thamanisha is not liable for indirect or consequential loss, or for investment losses arising from decisions you make. Nothing in these terms excludes liability that cannot be excluded by law, including liability for fraud.
9. Suspension and termination
You may close your account at any time from Settings (including deleting your data, per the Privacy Policy). We may suspend or terminate accounts that materially breach these terms, with notice where practicable.
10. Changes to these terms
We may update these terms as the Service evolves. For material changes we will give reasonable notice in the product or by email. Continued use after the effective date constitutes acceptance.
11. Governing law and disputes
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over disputes arising from them.
